Licence agreement

This agreement covers software made by Simulant Labs, including DPS-85. It is written to be read.
Agreement
By installing or using the software you agree to these terms. If you don't agree, don't install or use it.
Licence
When you buy a licence, Simulant Labs grants you a non-exclusive, non-transferable licence to use the software.
- The licence is for one person.
- You may install and activate it on computers you own or control, up to the activation limit stated when you buy.
- You may use it for personal or professional work, including commercial music and sound production.
- Activation needs an internet connection once per computer.
You may not:
- redistribute, resell, rent, lend or share the software or your licence key;
- publish your licence key;
- remove or get around the licence protection;
- reverse engineer, decompile or disassemble the software, except where the law says you may.
Ownership
The software is licensed, not sold. Simulant Labs keeps all rights in it. Buying a licence gives you the right to use the software, not ownership of it.
Whatever you make with the software is yours. Simulant Labs claims nothing in your audio.
Payment and refunds
Purchases are handled by Lemon Squeezy, which is the merchant of record. Refunds are covered by the refund policy.
Updates
Updates for the major version you bought are included. Simulant Labs decides what fixes, improvements and features to release, and when. There is no promise of updates forever, or of support for every future operating system or host.
No warranty
The software is provided "as is", without warranty of any kind, express or implied. Simulant Labs does not promise that it will be free of errors, that it will run without interruption, or that it will work with every system or host.
Limit of liability
To the extent the law allows, Simulant Labs is not liable for indirect, incidental, special or consequential damages arising from the use of the software, or from not being able to use it. Total liability is limited to the amount you paid for the licence.
Nothing in this agreement limits rights you have under consumer law that cannot be limited by contract.
Termination
Your licence ends if you break these terms. If that happens, you must stop using the software and delete your copies of it.
Third-party software
The software includes third-party components under their own licences. They are listed in the third-party licences.
Changes
These terms may be updated. The date at the top shows the latest version. The terms in force when you bought your licence continue to apply to that purchase.
Governing law
This agreement is governed by the laws of the State of California, USA, without regard to its conflict of law rules.
